The occupation grants immunity to its soldiers when killing Palestinians and lashes the International Court of Justice

The IDF Military Prosecution granted full immunity to soldiers involved in killing Palestinians during confrontations or incidents in the Occupied Palestinian Territory by supporting them and providing them with judicial protection in case they are indicted by military or civilian courts.

Israeli Military Attorney Major-General Sharon Avik and US Department of Defense Legal Counsel Paul Nay claimed that the International Court of Justice had no authority to deal with the two countries’ military behavior.

Both of them spoke on the first day of the International Conference on Military Law, held in Herzliya.

Major General Sharon Afik said the International Court of Justice had no authority to consider the issues related to the Israeli-Palestinian conflict. Both of them spoke on the first day of the International Conference on Military Law, held in Herzliya.

Avic said at the conference that Israel’s position on the conflict with the Palestinians was that “the ICC has no authority to deal with matters related to the conflict.”

“Instead of acting as a last resort to genocide cases, The International Court deviates from the main issues and the legal authority for which it was created,” Avic said.

We note that article 5 of the Rome Statute of the International Criminal Court lists war crimes as a type of crimes the Court is competent to try their offenders.
